Snorin’ Seamus Terms of Service

Welcome aboard!
These Terms of Service (“Terms”) govern your access to and use of Snorin’ Seamus, including the Snorin’ Seamus Discord bot, Twitch integrations, Captain’s Crew website features, commands, messages, community tools, and related services collectively referred to as the “Service.”
Snorin’ Seamus is operated as part of Captain’s Crew by Heart Shaped Entertainment Media (“Captain’s Crew,” “we,” “us,” or “our”).
By installing, accessing, interacting with, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must meet the minimum age required to use Discord, Twitch, and any other platform through which you access Snorin’ Seamus.
The Service is not directed toward children under 13 years of age. You may not use the Service if applicable law or the rules of a connected platform prohibit you from doing so.
2. What Snorin’ Seamus Does
Snorin’ Seamus is an interactive fictional character and community assistant designed to support Captain’s Crew communities.
Depending on the features enabled, Snorin’ Seamus may:
- Respond to commands, mentions, and conversations.
- Provide information about Captain’s Crew.
- Welcome community members.
- Support community activities, rewards, announcements, and events.
- Connect Discord, Twitch, Captain’s Crew website, and game-related features.
- Maintain limited preferences, progression, identity links, or community-specific memory.
- Generate character-based or AI-assisted responses.
Features may be added, modified, limited, suspended, or discontinued at any time.
3. Permission to Add Snorin’ Seamus
Only a server owner, administrator, moderator, or other person with appropriate authorization may install or configure Snorin’ Seamus within a Discord server or other community.
By installing the Service, you confirm that you have permission to do so and that its use complies with the rules of your community and the connected platform.
Server administrators are responsible for properly configuring permissions, channels, features, and access within their communities.
4. Acceptable Use
You agree not to use Snorin’ Seamus to:
- Violate any law, regulation, or third-party right.
- Harass, threaten, abuse, impersonate, exploit, or harm another person.
- Distribute unlawful, hateful, sexually exploitative, fraudulent, or malicious material.
- Attempt to access accounts, systems, data, or features without authorization.
- Circumvent security measures, usage limits, bans, or permissions.
- Disrupt or overload the Service or its infrastructure.
- Reverse engineer, copy, scrape, resell, or commercially exploit the Service without written authorization.
- Use automated systems to spam commands or generate excessive traffic.
- Manipulate virtual currency, rewards, rankings, progression, or community features.
- Falsely represent Snorin’ Seamus as an official representative of Discord, Twitch, Steam, or another third party.
- Use responses from the Service to make dangerous, illegal, medical, financial, or legal decisions.
We may restrict or terminate access when we reasonably believe these Terms have been violated.
5. User Content and Messages
You retain ownership of content that you submit through connected platforms.
When you send a command, mention, question, or other content to Snorin’ Seamus, you grant us a limited permission to receive, process, transmit, and temporarily or persistently store that content as reasonably necessary to operate, secure, troubleshoot, and improve the Service.
You are responsible for the content you submit and must have the right to provide it.
Do not submit passwords, payment information, government identification numbers, private access keys, authentication tokens, health records, or other highly sensitive information to Snorin’ Seamus.
6. Character and AI-Generated Responses
Snorin’ Seamus is a fictional character. Some responses may be automatically generated or assisted by artificial intelligence.
Responses may occasionally be incomplete, inaccurate, unexpected, or inappropriate for a particular situation. They are provided for entertainment and general community purposes and should not be treated as professional, legal, medical, financial, safety, or emergency advice.
You are responsible for reviewing and evaluating information before relying upon it.
7. Virtual Items, Rewards, and Crew Coins
The Service may provide virtual currencies, points, achievements, inventory items, rewards, collectibles, or progression features.
Unless we explicitly state otherwise:
- Virtual items have no real-world monetary value.
- Virtual items cannot be exchanged for cash.
- Virtual items are not property, legal currency, cryptocurrency, or stored monetary value.
- Balances or rewards may be corrected when errors, abuse, duplication, or unauthorized activity occurs.
- Features and reward values may change as the Service develops.
Any future purchase involving real money will be governed by additional terms presented at the time of purchase.
8. Community-Specific Information
Information associated with one Discord server, Twitch community, or Captain’s Crew environment may be separated from information associated with another community.
Server administrators may control certain server-specific settings and features. Removing Snorin’ Seamus from a server may not immediately delete all associated records when some retention is needed for security, backups, legal compliance, or linked Captain’s Crew accounts.
Privacy and deletion requests are handled as described in the Snorin’ Seamus Privacy Policy.
9. Third-Party Platforms
Snorin’ Seamus may interact with services operated by third parties, including Discord, Twitch, WordPress, Steam, and other platforms.
Your use of those platforms is also governed by their respective terms and policies. We do not control and are not responsible for third-party services, outages, policy changes, security practices, or content.
Snorin’ Seamus is not sponsored by, endorsed by, or officially affiliated with Discord, Twitch, Valve, Steam, or other third-party platforms unless expressly stated.
10. Intellectual Property
Snorin’ Seamus, Captain’s Crew, Port Prosper, associated characters, artwork, stories, logos, software, branding, dialogue, and original materials are owned by or licensed to Heart Shaped Entertainment Media.
These Terms do not transfer ownership of our intellectual property to you.
You may not reproduce, distribute, sell, falsely claim ownership of, or create commercial derivative products from our protected materials without written permission, except where applicable law expressly allows it.
11. Availability and Changes
We work to keep Snorin’ Seamus operational, but uninterrupted availability is not guaranteed.
The Service may become unavailable because of maintenance, updates, technical problems, platform changes, security issues, internet interruptions, or circumstances beyond our control.
We may modify these Terms when the Service, our practices, or applicable requirements change. The updated version will be posted with a revised “Last Updated” date. Continued use after an update means you accept the revised Terms.
12. Suspension and Termination
You may stop using the Service at any time. An authorized server administrator may remove Snorin’ Seamus from a community.
We may suspend, limit, or terminate access when reasonably necessary to:
- Protect users, communities, systems, or data.
- Investigate misuse or security incidents.
- Comply with legal or platform requirements.
- Address violations of these Terms.
- Discontinue the Service or a particular feature.
Sections that reasonably should survive termination—including intellectual property, disclaimers, limitations of liability, and dispute provisions—will remain in effect.
13. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available.”
We do not guarantee that the Service will always be available, error-free, secure, accurate, or suitable for every purpose.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
14. Limitation of Liability
To the fullest extent permitted by law, Heart Shaped Entertainment Media and its owners, developers, contractors, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the Service.
This includes loss of data, virtual items, profits, reputation, access, community activity, or business opportunities.
Where liability cannot legally be excluded, our liability will be limited to the greatest extent permitted by applicable law.
15. Indemnification
To the extent permitted by law, you agree to defend and hold harmless Heart Shaped Entertainment Media and its representatives from claims, losses, liabilities, and reasonable expenses resulting from your unlawful use of the Service, your content, or your violation of these Terms or another person’s rights.
16. Governing Law
These Terms are governed by the laws of the State of [INSERT STATE], United States, without regard to conflict-of-law principles.
